Employee shall not, directly or indirectly, make any negative or disparaging statement, or release any information, or encourage others to make any statement or release any information that has the effect of embarrassing or criticizing the Company or any of its affiliates, the services and products offered or provided in the Business, including any of the Company’s or its affiliates’, as applicable, actual or prospective customers, competitors, employees or former employees, including any statements made to the press or other media in the United States of America or in any other country. The obligations of Employee pursuant to this Section 6.03 shall indefinitely survive any termination of this Agreement.

All foods found at 45 degrees F or below were kept and placed into the produce cooler to rapidly cool back to 41 degrees F. All foods found above 45 degrees F were voluntarily disposed; Violation: Critical — Repeat — Corrected during inspection — Refrigerated, RTE, TCS foods not properly date marked. Items were either disposed or dates were corrected; Violation: Critical — Repeat — Corrected during inspection — RTE, TCS food not properly discarded when required. Items out of date mark were disposed; Violation: Critical — Corrected during inspection — Observed WD-40 and ironing spray stored on the countertop in the deli area above single-service items. Chemicals were removed from the deli area; Violation: Corrected during inspection — Food packages received in poor condition. Observed dented cans on shelves for service. Additionally, some cans were observed in the discounted section, presumably due to their damaged state. Dents in top, bottom, or side seams, or very severe dents can create microtears in the metal providing access to bacteria which can grow, producing toxins. Dented cans found were disposed; Violation: Corrected during inspection — Observed four bottles of Raid insect spray stored in the back chemical storage areas. These chemicals are not approved for use in a licensed food facility. Raid was voluntarily disposed during inspection; Violation: Corrected during inspection — Label on a food packaged in-house did not contain all required information. Labels to be reprinted; Violation: Observed that the open air deli cheese island cooler was not maintaining foods at 41 degrees F or below; Violation: Corrected during inspection — Deli hot case not maintaining 135 degrees F or above. Unit adjusted properly by end of inspection; Violation: Observed that fruit and ready meal end cap cooler was not maintaining foods at 41 degrees F; Violation: Observed one ceiling tile in the bakery area that is not smooth and easily cleanable. Observed some walls in the back of the store are unsealed wood. Observed some missing floor tiles in the deli area. Observed some parts of the flooring coming up in the meat room; Violation: Repeat — Corrected during inspection — Observed some expired baby foods for sale in the baby food section. Observed expired baby foods for sale at reduced price in the clearance section. Expired baby foods were disposed at time of inspection.
